These general terms and conditions ("Agreement") outline the rules governing your use of the GetBuilder.ae and GetBuilder.net website ("Website"), the mobile application ("Mobile Application") once available, and any associated products or services (collectively, the "Services"). GetBuilder operates as an online aggregator for various construction-related services and collaborates with independent third-party providers.

This Agreement forms a legally binding contract between you ("Customer", "Service Provider", "User", "you", or "your") and GetBuilder Digital Solutions FZ-LLC ("GetBuilder", "we", "us", or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you are agreeing to these terms on behalf of a company, you confirm you are authorized to bind that entity to this Agreement.

2. Eligibility and Accounts

You must be at least 18 years old and capable of entering into a contract to use our Services. When creating an account, you are solely responsible for safeguarding its security and for all activities performed under it. You agree to provide accurate, current, and complete information. Supplying inaccurate or misleading contact information may lead to account termination.

3. Platform Role and Limited Responsibility

GetBuilder is a marketplace acting strictly as an intermediary that connects Customers seeking services with independent Service Providers. We do not perform construction services, sell materials, or guarantee the quality of any user, listing, or job.

Limited Responsibility for Information: GetBuilder provides a platform for connection. As such, we assume limited responsibility for the accuracy, completeness, or reliability of the information provided to our clients (including project descriptions and owner contact information) or to our users (including Service Provider contact details and qualifications). All parties are encouraged to conduct their own due diligence before entering into an agreement.

4. Referral of Customers and Project Lead Selling

By using the Services, you acknowledge that GetBuilder refers Customer projects to third-party Service Providers.

Distribution of Project Information: GetBuilder retains the explicit right to share, distribute, or sell individual project information and Customer leads to multiple Service Providers. The number of times a single project's information is sold or distributed depends on project specifics, market demand, and is determined entirely at GetBuilder's sole and absolute discretion.

5. Disputes Between Parties

Contracts for construction or related work are formed directly between Customers and Service Providers, completely independent of GetBuilder.

Dispute Resolution Waiver: Users are solely responsible for resolving any disputes arising from their engagements. While GetBuilder retains the right, at its sole discretion, to assist in mediating or facilitating communication between parties, we explicitly waive any obligation, liability, or responsibility to pursue resolution or act as a party to such disputes. The required legal path for resolving disputes between Customers and Service Providers is through official UAE arbitration or the appropriate UAE courts.

6. Fees, Payments, and Refund Policy

You agree to pay all applicable fees or charges associated with your account according to the pricing and billing terms in effect at the time they become due. You authorize us and our payment partners to process transactions as required to provide the Services.

Refund Policy: Because GetBuilder provides immediate access to digital connections and project leads, all fees paid for project information, lead acquisition, or premium platform features are strictly non-refundable. Exceptions may only be made at GetBuilder's sole discretion in circumstances where the purchased contact information is demonstrably false or completely invalid, provided the issue is reported to our support team within 48 hours of the transaction.

7. User Conduct and Prohibited Uses

You may not use the Services for unlawful purposes, to infringe upon intellectual property rights, to submit false information, or to attempt to bypass the security features of the Services. The Website will not provide goods or services to OFAC-sanctioned countries in accordance with UAE law.

8. Privacy Policy and PDPL

The collection, processing, and protection of your personal data, in compliance with the UAE Personal Data Protection Law (PDPL), are governed by a separate document. For details on how we handle your data, please review the GetBuilder Privacy Policy available on our website.

9. Intellectual Property

All current and future intellectual property rights—including copyrights, trademarks, patents, designs, and related rights—remain exclusively with GetBuilder Digital Solutions FZ-LLC and its licensors.

10. Content

All data, materials, and information you upload or submit through the Services ("Content") remain your property. You are fully responsible for ensuring that all Content is lawful, accurate, appropriate, reliable, and that you possess the rights necessary to use or submit it.

We may monitor Content submitted through the Services. You grant us permission to access, copy, distribute, store, transmit, reformat, and display your Content solely for the purpose of delivering the Services.

In addition, you grant us a license to use, reproduce, adapt, modify, publish, or distribute Content from your account for commercial, marketing, or similar purposes.

We may, but are not obligated to, remove Content that we consider to violate our policies or to be harmful or objectionable.

11. Accuracy of Information

Information provided on the Services may occasionally include typographical errors, inaccuracies, or omissions related to descriptions, prices, availability, promotions, or offers. We reserve the right to correct such errors and modify or update information at any time without prior notice, even after an order is submitted.

We are not obligated to update or clarify information on the Services except as required by law. Any posted update or refresh date should not be interpreted as indicating that all information has been updated.

12. Third-Party Services

If you choose to integrate or access third-party services (e.g., authentication tools), your use of those services is governed exclusively by their own terms. We do not endorse or assume responsibility for such services, including how they process data or interact with you.

You irrevocably waive any claims against GetBuilder Digital Solutions FZ-LLC arising from your use of third-party services.

By enabling such services, you authorize us to share your data as necessary to facilitate their functionality.

13. Backups

We may perform routine backups of the Website and its Content, although we are not obligated to do so. In cases of hardware failure or data loss, we may restore such backups to minimize downtime.

The Services may contain links to external websites or applications. Such links do not imply our endorsement or affiliation unless expressly stated. We do not examine or warrant the offerings or content of third-party resources and assume no responsibility for their actions, products, or services.

15. Disclaimer of Warranty and Limitation of Liability

The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, GetBuilder disclaims all warranties and shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including loss of profits, revenue, or business opportunities. Our total liability for any claim shall not exceed the greater of one US dollar or the amount you paid to us in the month preceding the event giving rise to the claim.

16. Indemnification

You agree to indemnify and hold GetBuilder Digital Solutions FZ-LLC, its affiliates, and employees harmless from any claims, losses, damages, or expenses arising from your use of the Services, your Content, or your misconduct.

17. Governing Law and Platform Dispute Resolution

This Agreement is governed by the laws of the United Arab Emirates. All disputes arising directly from this Agreement (between you and GetBuilder) fall under the exclusive jurisdiction of the applicable UAE courts.
